The witness was sworn.

389 Q Please state your name, rank, serial number and organization.

A Pvt. Carlton F. Johnson, 32677931, Headquarters Company, 3rd Battalion, 157th Infantry.

(The witness was advised of his rights under the 24th Article of War.)

390 Q Were you with Col. Sparks the day the Dachau Internment Camp was taken?

A I was with him part of the time.

391 Q Were you with him when he stopped the shooting of some German soldiers?

A Yes, sir, I was.

392 Q Did you hear the shooting?

A Yes, I did.

393 Q How far away from the place of shooting were you and Col. Sparks when you heard the shooting?

A We were behind the wall. I would say about 100 to 200 yards, and we could not see anything behind that wall.

394 Q What did Col. Sparks do when he heard the shooting?

A The best I remember he ran over there and hollered at them to stop shooting the gun.

395 Q Did you run over there with him?

A No, sir, I stayed back and he was getting ready to leave and he told me to run back and get his jeep, so I started back after the jeep.

396 Q Did you come back to this place after getting the jeep?

A No, he turned around and came up and we all got in the jeep and left the camp.

397 Q Do you know what he did about these German soldiers after he stopped the shooting?

A There was some medics of the Germans there and I believe he sent some of them over to look at them. I wasn't there with him.

398 Q Before the shooting I understand that the Germans who were supposed to be SS men were separated from the other prisoners. Were you around when this separation took place?

A No, sir, I don't believe I was. I was running all over the place that afternoon, but I don't believe I was there when they were separating them.

399 Q You do not know whether Col. Sparks was present or not when they were separating these prisoners?

A I could not say that either, sir.
